What Changed in 2026?
This year several ADU reforms took effect in an effort to simplify permitting, expand development opportunities, and reduce unnecessary barriers for homeowners. They focused on: 
  • Tightened and strengthened the permitting process
  • Expanded design flexibility, allowing taller and more versatile ADU structures on lots that previously seemed too constrained.
  • Ability to split some single-family lots into two parcels, opening the door for homeowners to build multiple units or even sell one parcel while retaining the other.

What Does This Mean for Your Property?

State law establishes minimum allowances for ADU's, while local zoning standards may permit larger structures depending on the town and property. Items that may effect the size of your ADU are whether it is a detached ADU or an attached ADU. A Junior ADU (JADU) can be within the existing home's footprint. Updates to parking requirements took effect in some area's, particularly if the property is close to public transit. 

The Financial Picture

A thoughtfully designed, permitted ADU can increase a property's market appeal and may increases a Bay Area home's value, depending on size, quality, and location. On the rental income side, a well designed ADU can generate meaningful income for a homeowner. In some cases owners move into the ADU and rent their primary home, thereby increasing their rental income even further.  Homeowners should consult their county assessor or tax professional regarding reassessment or any tax changes while in the planning phase to avoid surprises.
